Nedimovic: Expropriation for Public Property Too in Case of Reconstructions

The deputy prime minister and minister of agriculture, forestry and water management of Serbia, Branislav Nedimovic, has stated that the amendments to the Law on Expropriation shortened the deadlines for the responses of the competent organs, solved the issue of illegal objects of expropriation and defined the issue of an administrative transfer.

Explaining these amendments at the National Assembly of Serbia, Nedimovic said that they defined that the object of expropriation may be any form of property, including publicly owned immovable property, which has not been the case before.

He specified that the deadlines for the responses of the organs in charge of acting per request for the determining of a public interest were shortened and that the basis for determining a public interest was expanded.

– It has proven to be justified for a public interest to be determined in the case of a reconstruction and adaptation of an existing facility, and not just in the case of the construction of a new one, in cases when the realization of the project of the construction of a facility is of importance for Serbia and when that project is part of an international agreement – he said.


Nedimovic explained that there had been problems in the cases of certain rail corridors, where there was a need for expropriation, and the projects pertained to a reconstruction.

– This happened in the case of the reconstruction of the Nis-Dimitrovgrad railway. A large number of the facilities along the route used to be publicly owned and then went through a privatization. When that happens, you can’t easily get to those parcels which are necessary for the reconstruction – he pointed out, as reported on the government’s website.
