Commercial Court to deliberate on debt and sale of Slavija Hoteli on January 24
On January 24, the Commercial Court in Belgrade will be examining the petition for the cancellation of the decision of the Arbitration Council according to which Hotel Slavija Belgrade owes EUR 1.2 million to Fil-Sar, due to which the court executor sold a part of the hotel to the owners of IM Matijevic.
IM Matijevic conditionally bought Slavija Lux, as part of Hotel Slavija, at the auction of January 16, as the sole interested purchaser, for EUR 6.5 million.
The director of Hotel Slavija, Veselin Jovicevic, told Beta on January 22 that the court executor had not had the right to call the auction before the Commercial Court reached the decision on the request for postponing the enforcement of the decision of the Arbitration Council on the collection of the debt, but that he had nevertheless called the sale conditional due to a warning by the court.
– The court executor is acting counter to the law, tendentiously and very irresponsibly, as he has managed to partly carry out his intent of selling a part of the hotel, without allowing its management to exercise its legal rights and ask for the enforcement of the decision to be postponed until the Commercial Court determines whether the claims of Fil-Sar, owned by Katarina Saranovic, the widow of the murdered Branislav Saranovic, are valid – Jovicevic said.
He added that the court executor had long refused to answer the request by the hotel's management to postpone the enforcement of the collection, a requirement for the management to make the request at the court.
He said that the court executor had only responded to the request in January 2018 after the warning by the Appellate Court and that he had scheduled the auction before that, in December 2017.
