Stricter Penalties for Tax Violations from 2023

The Government of Serbia has adopted the amendments to the Law on Tax Procedure and Tax Administration which envisage the expansion of the possibilities of imposing measures of the ban on activities for a period of six months to three years. This pertains to not filing tax returns or not filing them on time, not calculating and paying tax obligations (VAT, contributions, income tax…) or being late with the payments.

The penalties for not filing a tax return amount to 20% to 75% of the amount of the tax owed as determined through tax control, and no less than RSD 400,000 for a legal person, or RSD 80,000 for an entrepreneur. The penalties for not paying the taxes amount to 10% to 50% of the amount of the tax owed as determined through tax control, and no less than RSD 250,000 for a legal person, or RSD 50,000 for an entrepreneur.


If, due to a late payment, you get two offence charges within two years, in addition to a monetary penalty, you will be banned from performing the activity for six months to three years.
