The National Assembly of Serbia has adopted the Law on the Amendments to the Company Law. Article 86 of the latest amendments envisages that “the enterprise name may not contain the word ‘Serbia’ or any word derived thereof, including all the forms which resemble that word, or the internationally recognized three-letter abbreviation of the Republic of Serbia, SRB”.

This has worried many who have operated with the word “Serbia” in their enterprise names for a longer time. They shouldn’t worry, though, as Ivan Nonkovic, an independent attorney who cooperates with Karanovic & Partners, explains for eKapija.

– This stipulation should not be applied retroactively. In other words, those that already contain the word “Serbia” in their enterprise names will not have to ask for permission – Nonkovic said.

He adds that the same practice applied when the restriction was being implemented for business entities.

– This rule already applies to business entities. That is, companies cannot contain the word “Serbia” in their names without a previous approval. The rule for entrepreneurs is now merely being harmonized with the rule for companies – Nonkovic says for our portal.
